Public Informational Hearing Requested for Certificate of Need Application

An affected party timely filed a request for a public informational hearing with the Ohio Department of Health over a Certificate of Need application for the relocation of long-term care beds to an existing nursing home in Hamilton County. No such hearing has been requested in Ohio in over fifteen years. This may be the first sign of an increase in legal proceedings surrounding Certificate of Need activities. Recent changes to Ohio’s Certificate of Need laws allow long-term care beds to be relocated to a contiguous county. This change has resulted in a steady increase in Certificate of Need applications since October, 2009. Further increases in Certificate of Need activity are expected as the Department prepares to accept Certificate of Need applications in July for the relocation of long-term care beds from a county with a bed excess to a county with a bed need. As Certificate of Need activities increase and bed supply and other market factors change, affected parties are beginning to take note and assess how these activities may affect their communities. Public informational hearings, pre-decisional objections, and appeals of Certificate of Need decisions are all available vehicles to address concerns. We expect that as Certificate of Need activities increase, the use of such vehicles by affected parties to address concerns will also increase.
